website you are agreeing to comply with and be bound by the following terms
and conditions of use, which together with our privacy policy govern
our relationship with you in relation to this website. If you do not
agree to them you may not use this website and should leave it immediately.
The Eyes of Common website is provided solely for your personal, non-
commercial use. You may not use this website for any commercial purpose.
We may from time to time change these Terms at our sole discretion. By
using this Website after any such change(s), you agree to comply with, and
be bound by, the Terms as changed.
We have taken care to ensure that the Items on our Website are presented
as accurately as possible. However colour clarity may vary depending on
the browser software or computer system used by you. We therefore cannot
guarantee that the colour of the actual item is absolutely accurate. Prices and
availability of goods is subject to change without notice.
PRICE/DELIVERY
All prices for Items available are inclusive of GST (where applicable) at 15%
and are shown in New Zealand Dollars (NZD).
We aim to deliver your order to the place and person of your choice, in perfect
condition and in the shortest time possible. All Standard orders will be sent via
NZ Post or Fastway Couriers. All orders will be sent within 4 working days of
the order being placed.
Delivery charges are free in New Zealand, the rest of the world is $19
(NZD). Please note that the customer is responsible for any duties, taxes and
customs charges that the package may incur.
RETURNS/EXCHANGES
If you are not completely happy with your purchase we will be happy to offer a
refund or exchange. Before returning something you must notify us within 48
hours of receiving your order by emailing us at online@eyesofcommon.com.
You will be provided with a returns form to print out and complete. This, along
with the original receipt must be returned in the parcel. We must receive the
item within 14 days of receipt.
For all items, except where the item is faulty, you will be required to arrange
and pay for the return of the products. It is recommended that proof of posting
and insurance for the value of the goods is obtained as we cannot accept
responsibility for parcels lost in transit. Returns must be received in perfect,
unused condition with all tags still attached. If any of these conditions are not
met the item will be returned to the purchaser.
If you would like to exchange an item please let us know in your email as
this will be subject to availability. Exchanged items will only be sent after the
returned goods have been received in perfect, unused condition.
All successfully returned items will be credited to the account used to
originally purchase the items within 10 working days, less any taxes, duties or
charges incurred.
PAYMENT
We accept Visa & Mastercard via the eWay system. You confirm that the
debit or credit card being used is yours and that all the personal information
which you are required to provide us as a customer is true and accurate. You
agree not to impersonate any other person or entity or to use a false name or
a name that you are not authorised to use. When your order is accepted and
processed, payment will be made in full.
LIABILITY AND INDEMNITY
In no event will we be liable for any loss or damage including without
limitation, indirect or consequential loss or damage, or any loss or damage
whatsoever arising from loss of data or profits arising out of, or in connection
with, the use of this Website.
You agree fully to indemnify us, our directors, employees, suppliers or other
representatives from and against all liabilities against all claims, liability,
damages, losses, costs and expenses, including reasonable legal fees,
arising out of any breach of the conditions by you or any other liabilities
arising out of your use of this website. We may terminate your use of the
website immediately if we consider that you have breached these terms and
conditions.
Every effort is made to keep the website up and running smoothly.
However, “Eyes of Common” take no responsibility for, and will not be liable
for, the website being temporarily unavailable due to technical issues beyond
our control.
